Terms of Service

You must be at least 13 years old, or the minimum age of digital consent in your country (and old enough to use TikTok in your region), to use the Service. If you are under the age of majority, you may use the Service only with the involvement of a parent or guardian.

PerkWave lets businesses run reward programs and lets customers (“creators”) earn rewards by posting public TikTok videos that tag a participating business. As a video’s public view count grows, higher reward tiers set by the business unlock.

You must provide accurate information and keep your credentials secure; you are responsible for activity under your account. You represent and warrant that the TikTok account you connect is your own and that you have the right to submit the videos you submit. Connecting an account you do not control, or impersonating another person or business, is prohibited.

• No bot views, purchased views, view exchanges, or any artificial inflation of view counts.
• No impersonation of another creator, person, or business.
• No submitting videos you do not own or that violate TikTok’s rules.
• No misuse of, interference with, or unauthorized access to the Service.

Reward eligibility, tiers, and redemption rules are set by each participating business, not by PerkWave.

• Rewards have no cash value and cannot be exchanged for money unless the business states otherwise.
• Rewards may be voided or revoked for fraud, fake views, or any breach of these Terms.
• Rewards may be subject to expiration and redemption windows set by the business.
• The participating business — not PerkWave — is responsible for honoring and fulfilling its rewards.

To participate as a creator you connect your TikTok account through TikTok Login Kit. You authorize PerkWave to access the profile and video information described in our Privacy Policy. Your use of TikTok remains subject to TikTok’s own terms and policies. PerkWave is not affiliated with or endorsed by TikTok.

Each participating business is a separate operator of its own reward program. Businesses may publish their own program-specific terms (eligibility, reward details, redemption rules), which apply in addition to these Terms. For the relationship between PerkWave and businesses, PerkWave provides the platform and acts as a data processor; the business is the operator of its program. A Data Processing Agreement applies and is accepted by businesses at sign-up.

Businesses may start on a free trial and then subscribe to a paid plan billed through Stripe on a recurring basis until cancelled. You can manage or cancel a subscription from the billing portal in your account. Fees already charged are non-refundable except where required by law.

You may stop using the Service and delete your account at any time. We may suspend or terminate access, and revoke rewards, for violations of these Terms or to protect the Service or its users.

The Service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, PerkWave is not liable for indirect, incidental, or consequential damages, or for rewards a business fails to honor.

These Terms are governed by the laws of the jurisdiction in which PerkWave is established, without regard to conflict-of-law rules. The courts of that jurisdiction have exclusive jurisdiction over any dispute, except where applicable law gives you the right to bring proceedings elsewhere. We encourage you to contact us first so we can try to resolve any issue informally.

We may update these Terms from time to time; continued use after changes means you accept the updated Terms. For legal notices, contact privacy@perkwave.app.
